A power of attorney is a document that allows you to legally authorize another person, known as your agent, to act on your behalf and in your name. You can give your agent authority to do virtually anything including dealing with your legal, property and financial affairs.

While a power of attorney is a very useful device, if legal authority to act on your behalf is given to the wrong person, it could have severe legal and financial consequences for you and your family. Where you appoint someone to act as your agent, there will always be a risk that your agent will:-

  • act fraudulently on your behalf – for example in the payment of creditors or the settlement of debts;
  • abuse his power by embezzling funds from your estate;
  • act negligently in the carrying out his duties thereby causing you financial loss;
  • entering into a contract the terms of which adversely affect you; and
